ISF Enforcement Next Phase
We have received our first official report from an importer who experienced cargo being detained at the port of entry for no Importer Security Filing (ISF) on file. This is the first sign that U.S. Customs & Border Protection (CBP) is ratcheting up the enforcement of ISF one more notch. The notification came in the form of a letter from CBP stating that the cargo would not be released until the ISF was filed.
We have not heard of any penalty or liquidated damage cases as of yet and CBP continues to be tolerant on accuracy and timeliness issues. We highly recommend that importers take one more look at their customs compliance program covering ISF and ensure that all of the bugs have been worked out. By now all importers should have received a copy of the ISF Performance Report from CBP, either directly or via their customs broker.

Importer Security Filing (ISF) One Week to Enforcement
If you or your company has ocean borne (maritime) cargo bound for the United States, you have exactly one (1) week from today to begin filing and complying with U.S. Customs & Border Protection’s (CBP’s) new Importer Security Filing (ISF) requirement.
The new rule and regulation has been in place since January 26, 2009, in an “unenforced” phase-in mode. On January 26, 2010, one week from today, CBP will begin aggressively enforcing the new rule and all cargo in the maritime domain will require that an ISF be filed no later than 24 hours before the vessel departure at origin. CBP has been adamant that ocean consignments arriving after January 26, 2010, without an ISF having been filed will be detained or otherwise delayed and could also be subject to a penalty of $5,000 per shipment.
