Importer Security Filing (ISF) Penalties

We are now beginning to hear rumors that U.S. Customs & Border Protection (CBP) has begun to issue liquidated damage claims for failure to file an Importer Security Filing (ISF). We are working to confirm this information and will report more in the June Trade Update.

In the meantime CBP has not publicly announced when they will move to the second phase of their escalated enforcement strategy which will most likely include penalties and liquidated damages ($5,000 per incident) for accuracy and timeliness. They continue to be plagued by bill of lading matching difficulties.
